Please read these Terms of Service carefully before ordering a Jamaica Land Research Report through HowJamaica.com/land. By placing an order or submitting an inquiry, you agree to be bound by these terms.
1. Scope of Service
HowJamaica provides independent property record checks for land located in Jamaica. Our service involves querying public statutory databases maintained by the National Land Agency (NLA), the Titles Division, and the Property Valuation Office. Deliverables include a written PDF summary and an audio voice note delivered to WhatsApp within 48 hours of receiving workable parcel details.
2. Not Legal Advice: HowJamaica is an independent research firm. We are not attorneys-at-law, nor are we licensed to practice law in Jamaica or any other jurisdiction. The information provided in our reports, voice notes, and communications is for general due diligence and informational purposes only. It does not constitute formal legal counsel, title opinions, or conveyancing representation. If you are facing a boundary dispute, adverse possession claim, or property purchase, you should retain a licensed Jamaican attorney.
3. Strict No-Refund Policy: As soon as an order is placed, our researcher incurs direct, non-refundable government search fees paid to the National Land Agency (NLA) via eLandjamaica, alongside dedicated working hours. Because these expenses are immediate and irreversible, all sales are final and non-refundable under any circumstances, including cases where the land is found to be unregistered, disputed, or owned by an unexpected party.
4. Unregistered Land & Registry Limitations
Approximately 40% of land in Jamaica remains unregistered common-law or family land without a Certificate of Title or Volume and Folio designation. If a search confirms that a parcel has never been brought under the Registration of Titles Act, this finding represents a complete and accurate search of the statutory register. In such cases, our report will document this status, cross-check the valuation roll, and outline the government Systematic Land Registration process.
5. Turnaround Time & Customer Information
Our standard turnaround time is 48 hours from the moment you submit adequate identifying details (such as parish, district, road name, landmark, or names on the land). Turnaround times apply to standard Jamaican business days. Delays resulting from missing customer information, ambiguous geographic landmarks, or temporary National Land Agency system maintenance will be communicated promptly.
6. Accuracy of Public Records
We rely upon the accuracy of official documents provided by the government of Jamaica at the time of search. HowJamaica cannot be held liable for administrative errors, omissions, or outdated records maintained within government department archives.
7. Limitation of Liability
To the maximum extent permitted by applicable law, HowJamaica's total liability for any claim arising out of our services shall not exceed the amount actually paid by you for the individual report ($49.99 USD).
8. Governing Law
These terms shall be governed by and construed in accordance with the laws of Jamaica. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the Jamaican courts.
